Please read these Terms of Service (“Terms”) carefully before using the services offered by Omaha Growth Partners (“Company,” “we,” “us,” or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

Omaha Growth Partners provides B2B cold email outreach and lead generation services for HVAC companies, as well as website design and development. The specific scope, pricing, and deliverables for each engagement are defined in a separate written agreement or proposal provided to you before work begins.

2. No Guarantee of Results

We make no guarantee of specific business outcomes, including but not limited to a specific number of leads, appointments, contracts, or revenue generated. Cold email outreach results depend on factors outside our control, including market conditions, your target audience, seasonal demand, your ability to follow up on leads, and the nature of your business. We guarantee professional execution of the agreed-upon services, not any particular commercial result.

3. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate, complete, and up-to-date information about your business
  • Respond to leads and inquiries we deliver in a timely and professional manner
  • Comply with all applicable laws, including CAN-SPAM, TCPA, and state law
  • Not use our services in connection with any unlawful, deceptive, or harmful business practice
  • Pay invoices by the due dates specified in your service agreement

4. Payment

Payment terms are as specified in your individual service agreement or proposal. We reserve the right to suspend or terminate services for non-payment after reasonable notice. All fees are non-refundable unless otherwise agreed in writing.

5. Intellectual Property

Upon full payment, you own the deliverables we create specifically for you (such as website files and copy). We retain ownership of our proprietary systems, templates, workflows, and tools used to provide services. We may reference your company as a client in our own marketing materials unless you request otherwise in writing.

6. Confidentiality

We treat information you share about your business, including pricing, customer lists, and strategy, as confidential and will not disclose it to third parties except as necessary to deliver the agreed services or as required by law.

7. Limitation of Liability

To the fullest extent permitted by law, Omaha Growth Partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services, including lost profits, lost revenue, or loss of business opportunity, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you to us in the three months preceding the claim.

8. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

Either party may terminate the service relationship with written notice as specified in the service agreement. We reserve the right to terminate services immediately if you violate these Terms or engage in conduct we reasonably determine to be harmful, unlawful, or in breach of your obligations.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Douglas County, Nebraska, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
